Terms & Conditions
Last updated September 4, 2026
These Terms & Conditions govern your use of the Septic Safety Registry (the “Service”), a web application operated by Septic Safety Ltd. (“Septic Safety”, “we”, “us”). By creating an account, registering a property, submitting a service record, or otherwise continuing to use the Service, you agree to these terms. You are contracting with Septic Safety Ltd.
1. The Service
The Service maintains a permanent digital record of septic system maintenance and inspection activity for registered properties. Registered septic service companies are our customers: they register properties, submit service and inspection records, and maintain each property’s Registry record. Each property’s Registry record page is public — no account is needed to view it, and property owners and the public do not hold accounts with us.
2. Accounts and authority
- You must provide accurate account and property information and keep it up to date.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- If you register on behalf of a company, you confirm you have authority to bind that company. Individuals must be of legal age in their jurisdiction.
3. Acceptable use
You must not:
- use the Service unlawfully, or for fraud, spam, or misrepresentation;
- submit inspection or service records that you know to be false, or record work that was not performed;
- infringe the intellectual property or privacy rights of others;
- interfere with the security or integrity of the Service, including malware, probing, scanning, scraping, or circumventing technical limits;
- reverse engineer, resell, or redistribute the Service.
4. Records and content
Submitted service and inspection records are intended to form a durable, tamper-evident history. Once submitted, a record is locked; corrections are made through an amendment that is appended to the record rather than by editing or deleting it. You grant us a limited licence to host and process the content you submit solely to operate the Service, including displaying non-sensitive record information on a property’s public verification page. Owner contact details, internal notes, and photographs are not shown publicly.
5. Intellectual property
Septic Safety Ltd. retains all rights in the Service, including its software, documentation, branding, and the Septic Safety Registry name and marks. You receive a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
6. Service level
We work to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Records reflect what providers submit; the Service is not a substitute for a professional on-site inspection or for the requirements of your local health authority.
7. Payment terms (service companies)
Septic service companies are billed $199 CAD per active Registry record, per year. Records opened during our closed beta are complimentary. Fees renew annually until cancelled.
We may publish a Recommended Retail Price of $299/year as commercial guidance only. Each service company decides what, if anything, it charges its own customers. Septic Safety Ltd. does not collect that retail payment from property owners, does not act in the transaction between a company and its customer, and does not pay commissions or revenue share to service companies.
Payment, billing, currency, tax, renewal, cancellation, and refund mechanics are handled by our reseller and are governed by Paddle’s Buyer Terms. If a company stops paying for a record, the record’s public page remains viewable as a historical record and no new service records can be added to it.
8. Reseller and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for orders placed with us by service companies. Paddle provides customer service inquiries for those orders and handles returns.
9. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations — including submitting falsified records. On termination, you may request an export of your records within 30 days, after which data may be deleted or anonymised, subject to any retention we are required to apply by law.
10. Liability
To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where such limitation is not permitted by law.
11. Indemnity
You indemnify Septic Safety Ltd. against claims arising from content you submit, your unlawful use of the Service, or your breach of these terms.
12. General
- These terms are governed by the laws of the Province of Ontario, Canada, and the courts of Ontario have jurisdiction over disputes.
- You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Neither party is liable for delays caused by events beyond its reasonable control.
- We may update these terms; continued use after an update constitutes acceptance of the revised terms.
